Terms of Service

These Terms of Service ("Terms") govern your use of attribu.tech (the "Service"), operated by Attribu ("we," "us," or "our"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 16 years old and able to enter a binding contract. If you accept these Terms on behalf of a company, you represent that you are authorized to bind that company.

2. Account

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized access.

3. Acceptable Use

You agree not to:

• Use the Service to track or collect data from visitors without the disclosures and consent required by applicable law (including GDPR, CCPA, and similar regulations)
• Collect special categories of personal data (health, political opinions, religion, sexual orientation, children's data) via the Service
• Install our tracking pixel on websites you do not own or control
• Reverse-engineer, decompile, or attempt to extract source code
• Resell the Service, white-label it, or wrap it as your own product, except as explicitly permitted by our plans
• Use the Service for illegal activity, spamming, or to send abusive traffic
• Interfere with or disrupt the Service or its infrastructure
• Probe, scan, or test the vulnerability of the Service without prior written consent

4. Your Data and Responsibilities

You retain all rights to data you or your visitors generate through the Service ("Your Data"). You grant us a worldwide license to host, process, and display Your Data as necessary to provide the Service.

You are solely responsible for:

• Displaying a privacy policy on sites that use our pixel, disclosing our tracking
• Obtaining cookie consent where required by law
• Honoring deletion and access requests from your visitors
• The legality of the data you collect and how you use it

We act as a data processor for Your Data; you act as the data controller. A Data Processing Addendum is available upon request.

5. Third-Party Services

The Service integrates with Stripe, Shopify, Google Ads, Meta Ads, Calendly, and other third-party platforms. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for their acts or omissions.

6. Fees and Payment

Free tiers are subject to usage limits published on our pricing page. Paid plans are billed monthly or annually in advance, are non-refundable except where required by law, and automatically renew. We may change pricing with 30 days' notice; changes take effect on your next billing cycle.

You are responsible for all applicable taxes unless we collect them on your behalf.

7. Suspension and Termination

We may suspend or terminate your account if you breach these Terms, if we suspect fraud or abuse, or if required by law. You may cancel your account at any time from the dashboard. On termination, we will delete Your Data within 30 days unless legally required to retain it.

8. Service Availability

We aim for high uptime but do not guarantee uninterrupted service. We may perform maintenance, add features, or deprecate features at our discretion. Paid plans with SLA commitments are described in your plan details, if any.

9. Intellectual Property

The Service, including all software, designs, logos, and documentation, is owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service per these Terms. All rights not expressly granted are reserved.

10. Feedback

If you send us feedback, suggestions, or bug reports, we may use them without restriction and without compensation to you.

11. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability for all claims arising from or related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 100. We will not be liable for indirect, incidental, consequential, or punitive damages, including lost profits or data.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party rights.

14. Governing Law and Disputes

These Terms are governed by the laws of Serbia, without regard to conflict-of-laws principles. Any dispute will be resolved in the competent courts of Serbia, unless applicable consumer-protection law grants you the right to sue in your place of residence.

15. Changes to These Terms

We may update these Terms. Material changes will be announced at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
